Terms and Conditions

Section 1: Applicability to Businesses and Definitions of Terms

(1) The following General Terms and Conditions apply to all deliveries between us, 1001 SMILES – V.A.D.P.O, hereinafter referred to as 1001 SMILES (https://1001smiles.de/) and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity (§ 13 BGB).

(2) The following definitions of terms are used:

Section 2: Conclusion of a Contract, Storage of the Contract Text

(1) The following provisions on the conclusion of the contract apply to orders via our online shop https://1001smiles.de/ .

(2) In case of conclusion of the contract, the contract is concluded with

(3) The presentation of goods in our online store does not constitute a legally binding contract offer on our part but is merely a non-binding invitation to the consumer to place an order. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.


(4) When an order is placed in our online store, the following provisions apply: The consumer submits a binding contract offer by successfully completing the order process provided in our online store.

The order is usually completed in the following steps (please note that there may be deviations depending on the payment method or country):

1) Selection of the desired goods
2) Confirm by clicking the “Add to cart” button
3) Checking the information in the shopping cart
4) Binding submission of the order by clicking the button “PayPal Buy Now” or continue to the checkout page by clicking the button “Continue to Pay”
5) Checking or correcting the data entered.
6) Binding submission of the order by clicking on the button “Order with payment” or “Buy now”

We will immediately confirm receipt of your order via an automatically generated email ("Order Confirmation"). This email confirms our acceptance of your order.

(5) Storage of the contract text for orders via our online shop:

The contract text is stored by us after the conclusion of the contract and sent to the customer via email. The customer can view and print the order details in this email, as well as access the terms and conditions via a link and, if necessary, print them using the specific browser print functions.
The invoice for the ordered goods is attached to this order confirmation email.

The consumer can also revoke the General Terms and Conditions at any time at https://1001smiles.de/termsandconditions/ Registered customers can view current and past orders in our customer area under My Account -> My Orders.

Section 3: Prices, Shipping Costs, Payment, Due Date

(1) The prices quoted include statutory VAT and other price components. In addition, any shipping costs, which will be clearly stated during the ordering process, apply.

(2) The consumer has the option of paying via PayPal and all common credit/debit cards.

Payment processing and buyer protection:
Payments are processed through secure and encrypted connections to ensure the safety of your data. Your payment information is not stored on our servers. Payments via PayPal and credit/debit cards include buyer protection, which supports the consumer in case of valid complaints. For more information on the terms of buyer protection, please refer to the respective payment service provider's websites.

3) The consumer agrees to receive only electronic invoices. The invoices will be sent to the customer via email in PDF format.

Section 4: Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for shipment within two to four business days. Delivery will take place no later than 10 business days. The delivery period begins on the day after the contract is concluded. If the last day of the period falls on a Saturday, Sunday, or public holiday at the delivery location, the period will end on the next business day. (2) The risk of accidental loss and accidental deterioration of the goods sold shall pass to the buyer only upon delivery of the goods to the buyer, even in the case of a sale by dispatch.

(3) Delivery is generally made by DHL and the European Post. In individual cases, another shipping service provider may be selected.

Section 5: Digital Products

(1) General Provisions: Our digital products, such as short stories and measuring devices, are available for download after the purchase is completed or the free additional product is added. By purchasing a digital product, you acquire a simple, non-transferable license to use the content for personal use.

(2) Copyright and Use: All digital products as well as associated images and photos are copyrighted. The right of citizenship remains with us bzw. at the eternal Haven of Rights.

(3) License information: By acquiring/receiving a digital product, you obtain a simple, non-exclusive, and non-transferable license to use the content for personal use. This license allows you to store and use the digital file on a device, but not to reproduce, distribute, or make the file or its contents publicly available.

(4) Delivery digital content:
(4.1) The purchase of digital content (e.g., PDFs, software, e-books) is completed by providing a download link immediately after payment is received. The customer will receive the digital file in their account or via email.
(4.2) Upon termination of the Order and the preparation of the Download, the Agreement shall apply.

(4) Right of withdrawal: Please note that, in many jurisdictions, the right of withdrawal for digital products is excluded once the download has begun. By purchasing a digital product, you agree that the download will begin immediately after the completion of the purchase process, and you acknowledge that your right of withdrawal expires once the download has started.

Retention of Property

We retain ownership of the goods until full payment of the purchase price before.

Section 6: Exchanges, Returns & Disturbances

6.1 Exchanges & Returns

(1) For all physical products not according to § 312 g Abs. 2 Nr. 1 BGB are excluded from the exchange or return, the statutory 14-day withdrawal period applies. Within this period, you may withdraw the agreement without giving any reasons. You can find more here in our page Right of Withdrawal..

(2) Compensation for the loss of value of the goods: Please note that we will require compensation for the loss of value of goods that have been diminished due to improper use. This applies particularly if the goods have been used beyond what is necessary to examine their nature, characteristics, and functionality.

(3) Hints on Avoiding Abuse: We would like to point out that the right of withdrawal is intended to give you the opportunity to examine the goods and return them if you are not satisfied. Using the goods beyond the necessary examination or abusing the right of withdrawal may result in compensation claims for loss of value and could lead to being excluded from future orders, as well as being reported to relevant abuse organizations. For more information, please refer to our page Right of Withdrawal.Furthermore, we reserve the right to cooperate with third-party providers who process personal data on our behalf in case of a legitimate suspicion of abuse of the right of withdrawal. (4) For products purchased according to § 312 g Abs. 2 Nr. 1 BGB or similar international laws are excluded from the exchange or return if we do not offer a return, refund, exchange, voucher on your account or replacement product, if:

Failures of book formatting, layout, spelling, grammar and appearance of content are expressly excluded from exchange and return.

It is at our discretion to provide a refund (including the method of refund), a credit to your account, or a replacement product. To request a refund, credit, or replacement, you must send us a photo and a brief explanation of the issue within 14 days of delivery. Please refer to our guidelines for Exchanges & Returns.

It is expressly emphasized that for custom-made products and goods that are individually manufactured and where the consumer’s specifications are decisive for production,we do not offer exchanges, returns, refunds, credits to your account, or replacement products unless the reason is attributable to our fault.

6.2 Cancellations and Modifications

Cancellation and Modification Terms

(1) No Cancellations or Modifications Since the ordered products are custom printed and enter the production process immediately after the order is received, cancellations or changes are no longer possible after the order. This also applies to digital products, which are made available immediately after purchase.

(2) Disclaimer The customer is responsible for the Correctness of Order Details, including Size, Color and Shipping Information, at the time of order.

Section 7: Right of Withdrawal for the Customer as a Consumer

Section 8: Warranty

(1) The legal warranty rights apply to the products we offer.

(2) Data communication over the internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. Therefore, we are not liable for the continuous and uninterrupted availability of the online service.

Section 9: Language of the Contract

German and English are the only languages available for the contract.

Section 10: Data protection

We (1001 SMILES) process the customer's personal data for specific purposes and in accordance with the legal provisions. The personal data provided for the purpose of ordering goods (such as name, email address, address, payment information) will be used by us to fulfill and process the contract. This data is treated confidentially and will not be shared with third parties who are not involved in the ordering, delivery, and payment process. The customer has the right to request, free of charge, information about the personal data we have stored. Additionally, the customer has the right to request the correction of incorrect data, blocking, and deletion of their personal data, provided that no legal retention obligations conflict.

Section 11: Prices and VAT

(1) Prices: All prices stated on this website are final prices. They include all price components but exclude VAT, as these transactions are conducted under the Italian "Regime Forfettario" tax system.

(2) VAT exemption: This transaction is exempt from VAT pursuant to Article 1, Paragraphs 54 to 89, of Law No. 190/2014 – Regime Forfettario.

Italian: Operazione effettuata ai sensi dell’art. 1, commi da 54 a 89, della legge n. 190/2014 – Regime Forfettario. Operazione non soggetta ad IVA.

(3) Zusätzliche Klarstellung: Aufgrund der Anwendung des Regime Forfettario wird keine Mehrwertsteuer auf die Produkte erhoben und ist auch nicht vom Käufer zu zahlen. Dies betrifft sowohl nationale als auch internationale Transaktionen.

Section 12: Consent to the Sending of Review Requests

As part of the ordering process, you agree that we may send you an email requesting a product review after the delivery of your ordered goods. This email is intended to improve our service quality and is based on your order with us.

If you do not wish to receive review requests, you can object to the use of your email address for this purpose at any time. You can object via the unsubscribe link in the email or by sending a message to our contact details provided below.

Section 13: Alternative Dispute Resolution pursuant to Art. 14 Para. 1 ODR-VO and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (ODR), which customers can access here. We are not obligated and not willing to participate in a dispute resolution process before a consumer arbitration board.

Section 14: Choice of Law

If any individual provisions of these Terms and Conditions of Sale and Delivery are ineffective or contradict statutory regulations, the remainder of the contract shall not be affected.
